Use of the site, including the purchase of products through it, is governed by the terms and conditions detailed in these rules. Please read these terms carefully before using the site. Viewing and/or using the site and/or purchasing products from it constitutes unconditional agreement to the terms detailed herein.

These rules are written in the masculine form for convenience only and apply equally to all genders.

1. General Provisions

   1. The operator of the "Damba" site (hereinafter: the "Store") is the company (345868350): Netanya, Weizmann 33, Apt. 20 (hereinafter: the "Company").

   2. The physical store address: Netanya, A.D. Gordon St. 2.

   3. The site serves as a platform for the sale of draft beer in plastic bottles, cans, and beer bottles, as well as snacks and related products.

   4. The company reserves the right to change the terms of these rules at any time without prior notice. The binding and final version of the rules is the one published from time to time on the site.

   5. In case of contradictions and/or discrepancies between the provisions of these rules and other publications, the provisions of these rules shall prevail.

2. Compliance with the Alcohol Sales Law

   1. Purchases on the site are permitted only for individuals aged 18 or older. When placing an order, the user declares that they meet this age requirement.

   2. The company may request that the customer present ID upon delivery to confirm their age. If the customer refuses to present ID and/or is found not to meet the age requirement, the package will not be delivered, and the delivery fee will still be charged.

   3. Purchases on the site are allowed only for holders of a valid Israeli credit card issued by one of the credit companies operating in Israel.

3. Purchase Process

   1. The presentation of products on the site does not constitute an "offer" as defined in the Contracts Law (General Part), 5733-1973, but rather an "invitation to make offers."

   2. Before placing an order, the user selects the desired products and enters personal details (full name, address, phone number, email address).

   3. The order will be approved only after authorization from the credit card issuer and/or the clearing company and provided the product is in stock.

   4. The company reserves the right not to approve any order for any reason at its sole discretion and without obligation to explain.

   5. Purchase and delivery details will be as stated on the product page and during checkout.

4. Pricing and Payment

   1. Prices listed on the site include VAT as required by law.

   2. The company may change product prices at any time without prior notice.

   3. Payment will be made via credit card or other secure payment methods listed on the site.

   4. Charges will only be applied after the order is confirmed and approved by the credit card issuer.

5. Delivery

   1. Orders will be delivered to the address specified by the customer during checkout, within the timeframes stated on the site or coordinated with the customer.

   2. Delivery fees will be stated during checkout and paid by the customer.

   3. Self-pickup from the store in Netanya, A.D. Gordon St. 2, is available by prior arrangement during store hours.

   4. If no adult (over 18) is present at the delivery address, delivery will not be completed, and an additional fee will be charged for a second attempt.

   5. Delays caused by force majeure, strikes, sanctions, system malfunctions, courier disruptions, or any events beyond the company's control will not be the company's responsibility.

6. Transaction Cancellation and Returns

   1. Cancellation of transactions will be in accordance with the Consumer Protection Law 5741-1981 and its regulations.

   2. A transaction may be canceled within 14 days of receiving the product or the document detailing the transaction (whichever is later) by sending written notice to the company.

   3. Cancellation is only possible if the product is in good condition, complete, in its original packaging, and unused.

   4. Food and beverages, including beer, that have been opened and/or consumed are non-refundable.

   5. In case of cancellation, the customer will be refunded within 14 days from the date of cancellation notice, minus a cancellation fee of 5% of the product price or 100 NIS (whichever is lower), and minus delivery charges (if paid).

   6. It is clarified that under Section 14C(d)(1), return or cancellation of orders for perishable goods is not allowed, including food, drinks, or items requiring controlled storage. The customer is not entitled to a refund in such cases.

   7. If a return, change, or cancellation is due to a defective item, the customer must return the defective product, and the site will arrange for repair or replacement.

   8. Returns are at the buyer’s expense.

7. Warranty

   1. The company is not liable for any direct or indirect damage incurred by the user or third parties due to the use of products sold on the site, except in cases of gross negligence by the company.

   2. The company is not responsible for product quality, except as explicitly stated by law or the manufacturer.

   3. The consumption of alcoholic beverages is solely the user’s responsibility. Excessive consumption may be harmful to health.

   4. The company is not liable for misuse of products contrary to the manufacturer's instructions and/or the law.

8. Intellectual Property

   1. All intellectual property rights on the site, including trademarks, patents, designs, images, texts, source code, and other materials, are the exclusive property of the company or third parties who granted it a license, and are protected by intellectual property laws.

   2. You may not copy, reproduce, distribute, transmit, publicly display, perform, publish, create derivative works from, sell, or lease any part of the website or its content without prior written consent from the company.
